Court Rejects EFCC’s Request to Arraign Yahaya Bello Without Legal Representation

Abuja, Nigeria – The Federal High Court in Abuja on Friday rejected the Economic and Financial Crimes Commission’s (EFCC) request to arraign former Kogi State Governor, Yahaya Bello, without his lawyers present.

 

Bello was brought to court by the EFCC to face charges related to a new case. However, the proceedings took an unexpected twist when it was revealed that Bello had no legal representation. The former governor informed the court that he had only learned of the arraignment late Thursday night, leaving him unable to contact his lawyers in time.

 

Despite the EFCC’s insistence, represented by Senior Advocate of Nigeria (SAN) Kemi Pinheiro, that the arraignment proceed, Justice Emeka Nwite ruled against it. The judge emphasized that proceeding without Bello’s lawyers would violate his fundamental right to a fair hearing. Justice Nwite acknowledged Bello’s claim of late notification and underscored the importance of legal representation in ensuring a fair judicial process.

 

In his brief ruling, Justice Nwite adjourned the case to December 13, 2024, and ordered that Bello remain in EFCC custody until then. The judge also directed that a hearing notice be served to Bello’s lawyers to ensure their attendance at the next hearing.

 

This decision highlights the judiciary’s commitment to upholding the rights of defendants, ensuring that legal processes are conducted fairly and just.
